I've been working on cleaning up my credit and have gotten several older negative entries deleted, including a foreclosure.
Now here is my dilemma. I have an account with B of A that showed two 30 day lates on my Equifax report from approximately two years ago. One of which is completely bogus (BofA posted my payment in the wrong amount). I attempted to dispute these entries and I was recently notified that not only were the two late payments verified, they now list EIGHT additional late payments with "date unknown". Now, I know that I did have several late payments from 95/96 (actually there are SEVEN from this time period as per Experian and TU). But for some reason they had not been listed with Equifax until now. My issue is not the fact that they are now reporting the old late pays (they should begin dropping off later this year anyway), but that they are reporting an incorrect number (8) and the fact that they don't list a date of these late pays. The bottom line is, how should I go about disputing these new entries, without shooting myself in the foot? I don't want to admit that there are "only" seven late pays, but then again, I want them to correct the erroneous entry. Another area that has me a little ticked, is the fact that they put "date unknown" how does this effect the SOL, when there is no date listed, is this even legal? BTW I have already contacted BofA directly re: the fact that one late pay listed is due to their mistaken posting and hopefully this will be rectified shortly. Any help or guidance you guys can give would be very helpful, thanks. |

It's my opinion that ANY derogs without dates are violating the FCRA. You should dispute with Equifax:
"Please immediately delete all late payments without dates." And since you already disputed with B of A, look for their "dispute" notation on your new reports. If they don't report the dispute or delete the lates, you can go after them for that. |

Would it also be a good idea to send a validation letter to B of A and make them prove that you were late?? Make them send a full accounting of your account(meaning each and every statement and copies of each and every payment) during this time period! Obviously, they will not be able to do this, then you can demand deletion of these late payment references!

Javan, BofA doesn't have to validate, they're the original creditor.
However, if they report a late for a payment that was made, as in this case, one can dispute with them as Mo did. This can easily be turned into a deletion of all lates if BofA doesn't promptly delete that late and report the dispute to the bureaus. |

Equifax removeth and puteth 2 more back!
I've been having similar problems with these dirt bags. Ive managed to have two collection accounts removed and EQ managed to find two more old collections to replace them. Thanks Equifax!

Willie, in defense of the CRAs, they don't go out "looking" for collections to put on your report. Sounds more like two collectors found you, or they just got your accounts.
No breaks ... The good news is that you said "old" -- hopefully easy to get deleted. |
