I filed bankruptcy in 1998. I was shocked to find out Norwest (now Wells Fargo) entered a foreclosure that shows as a public record on my trans union file. This mortgage was included in the bankruptcy and the other 2 credit reports indicate as such (although they show the last activity as 10/99, not 9/98, the bankruptcy date vs when the foreclosure was completed). I know they are in violation of the bankruptcy. What can I do? Do I have a valid claim for a lawsuit? I am furious.

In my foolishness, I never noticed this public record entry on my report even when I looked at it over a year ago, prior to closing on a home. I have bought 2 new cars since the discharge and a house, yet this inaccuracy has apparently been here right along.

Not quite sure where to put this. I'll just ask here.

If I file for bankruptcy, does the initial filing go on my credit reports? Also, how long til it goes on my credit report that I filed? Also, if I don't actually go through with the bankruptcy, because I choose to settle with my creditor, and I dismiss the bankruptcy, does the filing info come off, and would I have to request it to come off?

kazey, they probably CAN report the foreclosure, but it is currently an active case in federal court - we'll find out.

Johnnybgood, the filing will be reported and I think it rates just like a discharge - 10 years.
