i had never had a credit history, but in order to start one i had to file bankruptcy to remove what was never mine. its now been 4 years since my discharge and i have built 7 accounts in good standing ,never late . all the negative information has long been deleted.

while applying to chase manhatten bank and speedway /super america i read that your eligible for consideration if your not currently involved in a bankruptcy filing or planning on one. i was denied credit by both and was told the reason was the bankruptcy.

i was also told that i should not reapply with them in the future even when my bankruptcy comes off because there policy on bankruptcy is indefinate even if your credit worthy in the future.

is this discrimination , can something be done?

Yes, two things can be done. One of them, you already have.

1. Let other people know (like you have) - I'm sure they have no problem at Speedway / SuperAmerica taking cash, other cards, etc... from post BK folks - however, if we are "credit banned for life' - I can buy gas at countless other locations.

2. You can avoid Speedway / SuperAmerica and Chase. They need you, more than you need them. Plenty of other creditors out there, be selective - you have to call the shots with your money - not them!

Also - who told you about this policy? - it may not even be correct. Sometimes you can call the same place and talk to two different people and get two different answers.

4 years post BK clean - great job!

I had contacted there credit services department and I called back to confirm what I had been told.

As for the great job thanks,

as I noted before I had never had credit just mistakes on my report the bureaus refused to correct. I learned to appreciate credit after getting a start on it.

The courts here in cleveland ohio discourage you from filing against creditors because they want your attorney to do it for you. Got tired of sending useless
letters to the creditors who didnt respond, and the attorneys around here don't want to be bothered with
frca violations. They say its time consuming and doesn't pay much.

I don't understand why you filed bk if they weren't your accounts. I'm missing something!

i filed because i did not know my rights and collection agencys would not clear up or verify there mistakes. got tired of dealing with it.

I have never heard of such a thing, unbelievable. Well, you know better now. The proper way to handle that situation would have been to sue:

You might be able to sue your lawyer also. If he allowed you to file a bankruptcy on debts that were not yours - he left you liable for false information on your BK papers.

" penalty for making false statement: Fine of up to $500,000 or imprisionment for up to 5 years, or both. 18 U.S.C. $$152 and 3571.)

Great point! If there was a lawyer involved, he should be disbarred and jailed.
